FSSAI Takes Legal Action Against Nestle India for Sub-Standard Infant Formula and Misleading Advertising, ETHealthworld

Mumbai: The Food Safety and Standards Authority of India (FSSAI) said it has filed three adjudication cases against Nestle India over non-compliance of advertisement rules and sub-standard infant nutrition products.

In an update shared on social media platform Instagram, FSSAI said it found claims relating to “5 HMOs” and “Whey Protein” in Nestle’s infant formula products named NAN Excella Pro Stage 1 and Lactogen Pro 1.

The food regulation body said it had accordingly sought clarifications from Nestle India regarding the above claims.

According to FSSAI, “Both products were ound to be in contravention of Regulation 4(2) of the FSS (Foods for Infant Nutrition) Regulations, 2020, which restricts promotional claims/material intended to increase the saleability of infant foods, and Section 3 of the IMS Act, 1992, which prohibits their advertisement and promotion.”

FSSAI added that a sample of follow-up formula manufactured by Nestle India was found sub-standard with respect to Biotin content during laboratory analysis.

Subsequent re-analysis test of the formula also found the product to be sub-standard with respect to the prescribed Biotin requirement under the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020.
